These Terms of Use (“Terms”) govern your access to and use of the website https://scrapehub.app, the ScrapeHub web scraping platform, APIs, and related services (collectively, the “Service”) provided by ScrapeHub (“ScrapeHub”, “we”, “us”, or “our”).
Please read these Terms carefully before using the Service.
1. Acceptance of Terms
By creating an account, accessing, or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy, which are incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Service.
If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case “you” refers to that entity.
2. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that you are not prohibited from using the Service under the laws of any applicable jurisdiction, including applicable export control and sanctions laws.
3. Accounts
To use most features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration and keep it up to date;
- Maintain the confidentiality of your account credentials and API keys;
- Notify us immediately at support@scrapehub.app of any unauthorized access to or use of your account;
- Accept responsibility for all activities that occur under your account, whether or not authorized by you.
We reserve the right to refuse registration, or to reclaim usernames, at our discretion.
4. Description of the Service
ScrapeHub provides a cloud-based platform of ready-to-use web scrapers that allow you to submit URLs, search queries, and configuration parameters to extract publicly accessible data from third-party websites, and to receive results in structured formats such as JSON and CSV, via the dashboard or the API.
The list of supported data sources, available fields, and pricing for each scraper is published in the scraper library on our website and may change over time.
5. Credits, Billing and Payments
Usage-based pricing. The Service operates on a usage-based (pay-as-you-go) model. You purchase credits, which are consumed when extraction jobs deliver results. Pricing per result is displayed on the relevant scraper page before you run a job. You are charged only for results that are successfully delivered.
Payments. Payments are processed by Paddle, which acts as the Merchant of Record for all purchases. By making a purchase, you agree to Paddle's terms and authorize the charge to your selected payment method. All fees are stated exclusive of taxes unless indicated otherwise; you are responsible for any applicable taxes, duties, or levies.
Credits. Credits are non-transferable, have no cash value, and may not be resold. Credits do not expire while your account remains active.
Refunds. Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. In summary: unused credits may be refundable within the period stated in the Refund Policy; used credits are non-refundable; and credits are not refunded upon account termination for a breach of these Terms. If you believe you were charged in error, contact us at support@scrapehub.app within 30 days of the charge.
Price changes. We may change our pricing at any time. Price changes do not affect credits already purchased but apply to subsequent purchases.
6. Acceptable Use
You agree not to, and not to permit any third party to:
- Use the Service in violation of any applicable law or regulation, including data protection, privacy, intellectual property, and computer misuse laws;
- Extract, collect, or process data for unlawful purposes, including stalking, harassment, discrimination, spamming, or unauthorized surveillance of individuals;
- Attempt to access data behind authentication walls, paywalls, or other access controls that you are not authorized to access, or circumvent technical protection measures of third-party websites in violation of applicable law;
- Extract or process special categories of personal data (such as health, biometric, or financial account data) except in compliance with applicable law;
- Use the Service to develop, train, or operate any product or service that competes with the Service, or to benchmark the Service for a competitor;
- Interfere with or disrupt the integrity, security, or performance of the Service or its infrastructure;
- Probe, scan, or test the vulnerability of the Service, or attempt to gain unauthorized access to our systems or other users' accounts or data;
- Upload or transmit viruses, malware, or other malicious code;
- Misrepresent your identity or affiliation, or impersonate any person or entity when using the Service.
We may investigate suspected violations and cooperate with law enforcement authorities where appropriate.
7. Third-Party Websites
The Service interacts with third-party websites and data sources that we do not own, operate, or control. We make no representations or warranties regarding such third-party websites, including their availability, the accuracy or legality of their content, or their terms of service.
Third-party websites may change their structure, content, technical measures, or policies at any time, which may affect the availability, completeness, or accuracy of results delivered by the Service. We are not responsible for any such changes or their consequences.
8. Customer Responsibilities
You are solely responsible for:
- Ensuring that your use of the Service — including the sources you target, the data you extract, and how you use that data — complies with all applicable laws and regulations, including data protection and privacy laws (such as GDPR and CCPA), and with the terms of service of the websites you access through the Service;
- Determining whether you have a lawful basis to collect and process any personal data contained in extraction results, and fulfilling any obligations you may have as a data controller with respect to such data;
- Obtaining any consents, licenses, or permissions required for your use of extracted data;
- The accuracy of the inputs, URLs, and instructions you submit to the Service.
ScrapeHub provides a technical platform for automated data extraction and does not control, direct, or monitor the specific ways in which customers use the Service.
9. Customer Data
“Customer Data” means the inputs you submit to the Service (such as URLs, queries, and configuration parameters) and the results generated through your use of the Service.
- As between you and ScrapeHub, you retain all rights, title, and interest in and to Customer Data. We claim no ownership of it.
- You grant us a limited, non-exclusive license to process Customer Data solely to provide the Service, maintain security, comply with legal obligations, and improve platform reliability.
- Extraction results are stored for 6 months from generation and then automatically deleted. You may export or delete your results at any time before then. We are not responsible for retaining results beyond the stated retention period, and we recommend exporting data you wish to keep.
- We handle personal data as described in our Privacy Policy.
10. Intellectual Property
The Service — including our software, APIs, scrapers, website, documentation, design, logos, and trademarks — is owned by ScrapeHub or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service in accordance with these Terms, no rights are granted to you.
You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or create derivative works of any part of the Service, except to the extent permitted by applicable law notwithstanding this restriction.
If you provide us with feedback or suggestions, we may use them without restriction or obligation to you.
11. API Usage
Access to the API is provided through API keys issued to your account. You agree not to:
- Share, publish, or transfer your API keys to any third party, or use API keys belonging to another person or entity without authorization;
- Resell, sublicense, or provide access to the API to third parties as a standalone service without our prior written permission;
- Circumvent, disable, or interfere with rate limits, usage metering, or other technical restrictions of the API;
- Reverse engineer, decompile, or attempt to derive the source code or underlying methods of the API or scrapers.
You are responsible for all usage and charges incurred through your API keys. If you believe your API key has been compromised, revoke it immediately in the dashboard and notify us.
12. Availability and Service Changes
We strive to keep the Service available and reliable, but the Service is provided without any guarantee of uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or factors outside our control, including changes made by third-party websites.
We may modify, add, or discontinue features, scrapers, or data sources at any time. Where reasonably possible, we will provide advance notice of material changes that negatively affect your use of the Service.
13. Rate Limits and Fair Use
To protect the stability and integrity of our infrastructure, the Service is subject to rate limits and fair-use restrictions, which may vary by scraper or plan and may be adjusted from time to time. We may throttle, queue, or reject requests that exceed applicable limits or that, in our reasonable judgment, place excessive load on the Service or on third-party websites. Deliberate attempts to circumvent rate limits are a material breach of these Terms.
14. Suspension and Termination
By you. You may stop using the Service and delete your account at any time through your account settings or by contacting us.
By us. We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if:
- You materially breach these Terms, including the Acceptable Use and API Usage provisions;
- We are required to do so by law or by a request from a competent authority;
- Your use of the Service creates a security risk, may harm the Service, other users, or third parties, or may expose us to liability.
Upon termination, your right to use the Service ceases immediately, and we may delete your account data and Customer Data in accordance with our retention practices. Sections that by their nature should survive termination (including Sections 9, 10, 15, 16, 17, and 20) will survive.
15. Disclaimer of Warranties
The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Without limiting the foregoing, we do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the results obtained through the Service will be accurate, complete, or reliable; or (c) any data source will remain available or compatible with the Service.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
16. Limitation of Liability
To the maximum extent permitted by applicable law:
(a) In no event shall ScrapeHub, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, business opportunities, or business interruption, arising out of or relating to the Service or these Terms, even if we have been advised of the possibility of such damages;
(b) Our total aggregate liability arising out of or relating to the Service or these Terms shall not exceed the total amount paid by you to us during the twelve (12) months preceding the event giving rise to the claim.
The limitations in this section apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if any limited remedy fails of its essential purpose. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
17. Indemnification
You agree to indemnify, defend, and hold harmless ScrapeHub and its officers, directors, employees, and agents from and against any claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use or misuse of the Service;
- Your violation of these Terms or of any applicable law;
- Your violation of the terms of service or rights of any third party, including websites accessed through the Service;
- Your collection, processing, or use of any data obtained through the Service, including any personal data contained therein.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense.
18. Force Majeure
We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, governmental actions, power or Internet outages, failures of third-party hosting or infrastructure providers, distributed denial-of-service attacks, or other large-scale technical failures.
19. Changes to These Terms
We may modify these Terms from time to time. When we do, we will update the “Last updated” date above. For material changes, we will provide reasonable advance notice, such as by email or a notice within the Service. Changes become effective on the date indicated in the notice. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
20. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy, the Refund Policy, and any order or plan details, constitute the entire agreement between you and ScrapeHub regarding the Service.
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
- Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- No third-party beneficiaries. These Terms do not create any rights for third parties.
